Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Awaaz FM website (including awaazfm.com), mobile applications, live audio streams, and related services (together, the "Service"), operated by Awaaz FM ("Awaaz FM," "we," "us," or "our").

By downloading, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

Awaaz FM provides Urdu-language and related radio streaming, program schedules, listener accounts, song and advertisement requests, promotional banners, and related features for entertainment and community engagement. Features may vary by platform (web or mobile) and may change over time.

Streaming quality and availability depend on your internet connection, device, and network conditions. We do not guarantee uninterrupted, error-free, or continuous access.

Some features (such as favorites, song requests, advertisement inquiries, and account settings) require registration. When you create an account, you agree to:

• Provide accurate, current, and complete information;
• Keep your login credentials confidential and secure;
• Notify us promptly of any unauthorized use of your account; and
• Accept responsibility for activity that occurs under your account.

We may refuse registration, require email verification, or suspend accounts that appear fraudulent, abusive, or in violation of these Terms.

You agree not to:

• Use the Service for any unlawful purpose;
• Harass, threaten, or abuse Awaaz FM staff, DJs, advertisers, or other users;
• Spam song requests, advertisement requests, support messages, or other forms;
• Attempt to disrupt, overload, scrape, reverse engineer, or gain unauthorized access to streams, servers, APIs, or accounts;
• Redistribute, rebroadcast, record for commercial use, or publicly perform our streams or content without prior written permission;
• Upload or submit content that is defamatory, obscene, infringing, hateful, or otherwise objectionable; or
• Interfere with advertisements, analytics, or security features of the Service.

We may investigate violations and suspend or terminate access without notice where we reasonably believe these Terms have been breached.

If you submit song requests, advertisement inquiries, support feedback, or other content ("Submissions"), you retain ownership of your Submissions, but you grant Awaaz FM a worldwide, non-exclusive, royalty-free license to use, store, review, and process them as needed to operate and improve the Service and to respond to you.

You represent that your Submissions do not infringe others' rights and that you have authority to submit them. Song and ad requests are discretionary; we are not obligated to play, publish, or accept any request.

The Service—including streams, programs, schedules, logos, branding, software, and design—is owned by Awaaz FM or its licensors and is protected by copyright, trademark, and other laws. Personal, non-commercial listening and use of the apps as provided is permitted. Any other use requires our prior written consent.

The Service may display sponsored banners and other promotions. Clicking an advertisement may take you to a third-party website or app. We are not responsible for third-party content, products, privacy practices, or availability. Your dealings with advertisers are solely between you and that third party.

If you download our app from Apple App Store or Google Play, you also agree to the applicable store's terms. Stores are not responsible for support, maintenance, or claims relating to the app. In case of conflict between these Terms and store rules about the store's rights, the store rules control for that relationship.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AWAZ FM AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR STREAM INTERRUPTIONS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).

Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Awaaz FM and its operators from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your Submissions, or your violation of these Terms or applicable law.

You may stop using the Service at any time and may delete your listener account from the mobile app Profile screen (when signed in). We may suspend or terminate access to the Service, with or without notice, for conduct that we believe violates these Terms or harms the Service or other users. Sections that by nature should survive (including intellectual property, disclaimers, limitations, and indemnity) will survive termination.

We may modify the Service or these Terms from time to time. We will update the "Last updated" date on this page. Continued use after changes become effective constitutes acceptance of the revised Terms. If you do not agree, stop using the Service.

These Terms are governed by the laws applicable in the Province of Ontario, Canada, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence require otherwise. Courts in Ontario shall have exclusive jurisdiction, subject to those mandatory rights.
